PUBLIC OFFER
for Registration and Participation in a Sports Event

1. GENERAL PROVISIONS

1.1. This Public Offer (hereinafter referred to as the “Offer”) is an official proposal of the NNO “Triathlon Federation of Uzbekistan” (hereinafter referred to as the “Organizer”) to conclude an agreement for participation in a sports event with any legally capable individual (hereinafter referred to as the “Participant”).

1.2. The Offer is published on the Internet on the website
www.triathlon.uz.

1.3. Acceptance of this Offer is deemed to occur when the Participant registers on the website and pays the registration fee.

1.4. By accepting this Offer, the Participant confirms that they:

-       have carefully read the terms of this Offer;

-       fully understand the content and legal consequences of its acceptance;

-       accept all terms of this Offer without any reservations.

2. SUBJECT OF THE AGREEMENT

2.1. The Organizer grants the Participant the right to take part in the sports event (competition) specified on the website.

2.2. At the same time, the Participant is obliged to:

-       complete the registration procedure;

-       pay the registration fee;

-       comply with the competition rules and the Organizer’s requirements.

2.3. Payment of the registration fee confirms the conclusion of an agreement between the Participant and the Organizer.

3. REGISTRATION FOR THE COMPETITION

3.1. Registration is carried out through the website www.triathlon.uz.

3.2. During registration, the Participant must provide accurate personal data.

3.3. The Organizer reserves the right to:

-       refuse registration to the Participant;

-       cancel the registration;

-       deny the Participant permission to start in the event in case of violation of the terms of this Offer or the competition rules.

4. REGISTRATION FEE

4.1. The amount of the registration fee is indicated on the website.

4.2. The Organizer has the right to change the participation fee prior to registration.

4.3. The registration fee grants the right to participate in the competition and receive the services specified on the website.

4.4. The registration fee is non-refundable, except in cases provided for by the legislation of the Republic of Uzbekistan or the competition rules.

5. VOLUNTARY PARTICIPATION AND PARTICIPANT’S HEALTH CONDITION

5.1. The Participant confirms that participation in the competition is voluntary.

5.2. The Participant confirms that they:

-       are in proper physical condition;

-       have no medical contraindications for participation in the competition;

-       are capable of safely participating in the competition.

5.3. The Participant bears sole responsibility for their health condition.

5.4. If necessary, the Participant undertakes to provide a medical certificate confirming eligibility to participate in the competition.

6. PARTICIPANT’S MEDICAL RESPONSIBILITY

6.1. The Participant confirms that they have independently assessed their health condition before participating in the competition.

6.2. The Participant assumes full responsibility for any possible deterioration of their health during the competition.

6.3. The Organizer is not responsible for consequences related to the Participant’s health condition resulting from participation in the competition.

7. AWARENESS AND ACCEPTANCE OF RISKS

7.1. The Participant confirms that they understand that triathlon is a sport with an increased level of risk.

-       7.2. The Participant acknowledges that participation in the competition may involve various hazards, including but not limited to:

-       risks associated with open-water swimming, including the possibility of drowning;

-       traffic accidents during the cycling stage;

-       falls and collisions with other participants;

-       heat stroke, dehydration, or hypothermia;

-       sudden deterioration of health;

-       cardiovascular complications;

-       injuries of varying severity;

-       disability or death.

7.3. The Participant confirms that they fully understand the above risks and voluntarily accept them.

8. RELEASE OF THE ORGANIZER FROM LIABILITY

8.1. The Participant participates in the competition at their own risk.

8.2. The Participant releases (undertakes not to make any property or other claims against) the NNO “Triathlon Federation of Uzbekistan”, as well as:

-       employees of the Organizer;

-       competition judges;

-       volunteers engaged by the Organizer;

-       contractors of the Organizer;

-       partners of the Organizer;

-       sponsors of the Organizer;

-       representatives of state authorities, etc.

-       from any liability for harm to health, injury, disability, death, or damage to property that may arise as a result of participation in the competition.

9. PARTICIPANT’S LIABILITY TOWARD THIRD PARTIES

9.1. The Participant bears personal responsibility for their actions during the competition.

9.2. In case of harm caused to other participants, spectators, judges, volunteers, or third parties, the Participant independently bears responsibility for such damage.

9.3. The Participant undertakes to compensate for damage caused to third parties due to their fault.

9.4. In the event that claims or lawsuits are brought against the Organizer related to the actions of the Participant, the Participant undertakes to compensate the Organizer for all incurred losses, including legal expenses.

10. MEDICAL ASSISTANCE

10.1. The Participant gives consent to receive medical assistance if necessary.

10.2. The competition medical personnel have the right to decide to remove the Participant from the race for medical reasons.

10.3. The Participant undertakes to comply with the instructions of the medical personnel.

11. ORGANIZER’S RIGHT TO REMOVE A PARTICIPANT FROM THE COURSE

11.1. The Organizer, judges, or medical personnel have the right to remove a Participant from the course if:

the Participant’s health condition raises concerns;

the Participant violates competition rules;

further participation may pose a threat to the Participant or others.

11.2. The Participant undertakes to immediately comply with the instructions of judges and medical personnel.

12. RESPONSIBILITY FOR EQUIPMENT AND SAFETY

12.1. The Participant is responsible for the technical condition of their sports equipment.

12.2. The Participant must use proper and safe equipment, including a bicycle, helmet, and other gear.

12.3. The Participant undertakes to comply with traffic rules during the cycling stage.

12.4. The Organizer is not responsible for traffic accidents caused by participants or third parties.

13. ADDITIONAL LIMITATION OF THE ORGANIZER’S LIABILITY

13.1. The Organizer is not responsible for:

-       actions of third parties;

-       actions of other participants;

-       weather conditions;

-       loss or damage of personal belongings;

-       circumstances beyond the Organizer’s control.

13.2. The Participant agrees that the competition is held in an open sports environment and may include unpredictable factors.

14. PHOTO AND VIDEO RECORDING

14.1. The Participant consents to photo and video recording during the competition.

14.2. The Participant grants the Organizer the right to use images, photos, and videos featuring the Participant for informational and promotional purposes.

14.3. The Participant has no right to claim compensation for the use of such materials.

15. PERSONAL DATA

15.1. The Participant consents to the processing of their personal data.

15.2. Personal data processing is carried out in accordance with the legislation of the Republic of Uzbekistan.

15.3. Personal data may be used by the Organizer for:

-       registration;

-       preparation of official race protocols;

-       publication of results;

                     creation of rankings.

15.4 By accepting this offer, the Participant gives their consent for the Organizer to transfer their personal data to a third party — World Triathlon

16. FORCE MAJEURE

16.1. The Organizer is not responsible for failure to fulfill obligations in case of force majeure circumstances.

16.2. Such circumstances include:

-       natural disasters, adverse weather conditions, decisions of state authorities, security threats, epidemics, and other circumstances beyond the Organizer’s control.

16.3. In the event of such circumstances, the Organizer has the right to change the distance, format, date of the competition, or cancel the event.

17. FINAL PROVISIONS

17.1. This Offer enters into force from the moment it is published on the website.

17.2. The Organizer has the right to make changes to the terms of the Offer.

17.3. All disputes and disagreements shall be resolved through negotiations.

17.4. If no agreement is reached, the dispute shall be resolved in court in accordance with the legislation of the Republic of Uzbekistan.
